Some late breaking news tonight. It appears that Judge Koh has denied Apple’s attempt to get a sales ban on many different Samsung devices in the US. This comes about 4 months after their trial ended and Samsung was to pay Apple over $1 billion in damages. Judge Lucy Koh, who has been ruling over the entire case, denied the ban based on infringing features were just part of a larger feature set and making the sales ban too broad.
Judge Koh wrote the following regarding the ruling:
“The phones at issue in this case contain a broad range of features, only a small fraction of which are covered by Apple’s patents,”
“Though Apple does have some interest in retaining certain features as exclusive to Apple, it does not follow that entire products must be forever banned from the market because they incorporate, among their myriad features, a few narrow protected functions.”
So it looks like this is a huge win for Samsung here in the US. Especially since the Galaxy S2, S3, and Note 2 were all in this ban that Apple was trying to get. Of course there were more than just those three devices, but those are Samsung’s top sellers right now. But believe me the war is not over, and we have not heard the end of Samsung v Apple. But hopefully it’s the end for now.
