Earlier this month, a judgement by the Delhi High Court meant that OnePlus wasn’t allowed to import, market or sell its devices in the country. Only the left-over stock was allowed to be ‘disposed of’. Now, that’s quite a strong reaction in your first month in a new market. OnePlus had only launched the OnePlus One on December the 2nd in India, and would’ve certainly not seen that coming. However, the rights to the CyanogenMod OS and future updates thereof were bought by Micromax, which will be using the OS on its latest Yu Yureka. Thus, Micromax was well within its rights to file a lawsuit against OnePlus and ask for the One to stop using the CyanogenMod OS.
However, there’s been a slight turn in the story, one that’s bound to give OnePlus a ray of hope as well. The Delhi High Court has lifted the ban on OnePlus, which means the company can now resume marketing, importing and selling the One in India. “An ad-interim injunction is normally issued when a very strong prima-facie case is made out by the plaintiff and the injury to the plaintiff is writ large if the defendant is not restrained from doing the activity which causes the injury to the plaintiff. In such a case the balance of convenience would obviously be in favor of the plaintiff. Since interim injunctions affect the right of a defendant, the principle of natural justice would warrant the defendant to be heard before an order adverse to the defendant’s right is passed,” added the court judgement, ruling in OnePlus’ favor after the latter roped in top lawyer Mr. Kapil Sibal as its defendant for the case.
A hearing will now be conducted on the 7th of January next year, where besides OnePlus and Micromax, reps from CyanogenMod will be tackling the Delhi High Court. The previous court ruling turned out to be quite an affair, since it contained the raw correspondence between OnePlus co-founder Carl Pei and CyanogenMod Inc. CEO Kirt McMaster. The emails also went on to show that the OnePlus – CyanogenMod relations had been shaky since quite a while.
