HTC Facing Lawsuit Over New Phone "ChaCha"

At the Mobile World Congress this year HTC announced the “HTC ChaCha” with it’s dedicated Facebook button. Only one problem, there is a very large mobile business entitled “ChaCha” and they do not seem to like the fact that HTC is using the same name on their phone. ChaCha Inc. filed a lawsuit last Tuesday in Indiana Southern District Court claiming trademark infringement. As TechCrunch points out, due to the fact that ChaCha Inc does in fact own the trademark in the United States and Europe, and that their business operatres mostly in the mobile market (and has an Android app) they might win this battle. You have to wonder whether these hardware manufacturers don’t do enough trademark and branding research before they launch massive campaigns for products, or if they simply don’t care and deem the risk for infringement lawsuits an acceptable, calculated one.
