The case between Apple and Motorola was scheduled to start on Monday, but the judge being very frustrated with both their cases so far, has decided to dismiss the case altogether. He says the biggest issue is that neither party have put forward how much in damages are we talking about here, and since both agreed that this could all be solved through money exchanging hands, yet none of them said yet what the damage is, he decided to throw the case.
“I have tentatively decided that the case should be dismissed with prejudice because neither party can establish a right to relief. The trial scheduled to begin this coming Monday is therefore canceled”
This is not the first time this judge was especially upset with Apple for wasting his time with useless motions, and he’s probably had enough with the whole trial and then nonsense that is the patent system. Apple is probably not very thrilled with this decision, and they will push forward with this, while Motorola seems to be content with the judge’s decision:
“We are pleased by the Illinois trial court’s tentative ruling today dismissing Apple’s patent claims and look forward to receiving the full decision.”
Even though the new CEO of Apple, Tim Cook, has said that he doesn’t really like all the lawsuits, I think we all know that these patent battles are far from being over, and we’re probably still at the beginning of it all.
