HTC Fires Back At Apple With Lawsuit

HTC recently handed Apple a counterclaim about Apple’s patent infringement lawsuit with the District Court of Delaware. In the counterclaim, HTC says, “Defendants admit that some of the asserted patents purport to cover generally various software and/or hardware technologies that could be used in mobile communication devices and/or other products. Defendants otherwise lack knowledge or information sufficient to form a belief as to the truth of the allegations.” HTC otherwise claims that there is not enough information “to form a belief as to the truth” of the patent infringement allegations.

Apple originally served its patent lawsuit to HTC, with a complaint with the International Trade Commission (ITC), claiming that HTC infringed on twenty of its patents. At the time, Steve Jobs said, “We can sit by and watch competitors steal our patented inventions, or we can do something about it. We’ve decided to do something about it.”

By May, HTC filed a complaint of its own with the ITC, requesting it to halt iPhone, iPad, and iPod sales and imports in the U.S. “We are taking this action against Apple to protect our intellectual property, our industry partners, and most importantly our customers that use HTC phones,” Jason Mackenzie, vice president of North America, HTC Corporation, said.

In July, Apple added two more patents into the lawsuit, describing a “system for real-time adaptation to changes in display configuration.”

Apple has not yet responded to HTC’s rebuttal.There isn’t any specific information about the specific patents, but it;s interesting to know what they are really suing each other about.

Seems like the war of the patents, If there is any one winner it will be devastating to the company, but this seems to will take years upon years to resolve. It will most likely end with a cease fire on both side and things will continue as they are currently happening.
